User must be 18 years or older to use the services of Ps Services. By registering/visiting/signing up the Ps Services service, User represent and warrant that User are 18 years or older and that User have the capacity to understand, agree to and comply with these Terms of Service. Since Indian laws do not permit us to contract with a minor person (minor is a person who has not completed 18 years of age), we do not market our Web site to minor person under the age of 18. However, a minor can apply for various services offered by Ps Services under the supervision and guidance of guardian.

All Information provided by the applicant should exactly and completely match the details present on the document proofs submitted. Any Discrepancy in the Documents Attached and/or Application Form filled will be sole responsibility of the User and Ps Services will not be liable to pay any refund amount back to the user in case of any such discrepancy or any issues that may arise due to such discrepancy.

Changes To Terms And Conditions

We reserve the right to add to or change/modify the terms of this Agreement including but not limited to suspend/cancel, or discontinue any or all service at any time without notice, make modifications and alterations in any or all of the content, products and services contained on the site without prior notice. Such changes will be posted to Ps Services for your convenience to understand your responsibility as a user. Users are responsible for regularly reviewing these Terms of Service so that User will be apprised of any changes. User will be deemed to have accepted such change/s if User continue to access the Site subsequent to such changes.

Prohibited Conduct

By accessing or using the Ps Services Platform or by availing Ps Services Services, User agree not to:

• Violate the T&Cs;
• Impersonate any person or entity, falsely claim or otherwise misrepresent Your affiliation with any person or entity, or access the accounts of others without permission, forge another person’s digital signature, misrepresent the source, identity, or content of information transmitted via the Ps Services Services, perform any other similar fraudulent activity or otherwise avail Ps Services Services with what we reasonably believe to be potentially fraudulent funds;
• Infringe our or any third party’s intellectual property rights, rights of publicity or privacy;
• Use the Ps Services Services if User are under the age of 18 years without a parental sponsor or, in any event, use the Ps Services Services if User are under the age of 13 years old even with a parental sponsor and in accordance with applicable law;
• Post or transmit any message which is libelous, defamatory or which discloses private or personal matters concerning any person;
• Post or transmit any message, data, image or program which is pornographic, vulgar or offensive in nature;
• Refuse to cooperate in an investigation or provide confirmation of Your identity or any other information provide by User to Ps Services;
• Remove, circumvent, disable, damage or otherwise interfere with security-related features of the Ps Services Services and the Ps Services Platform or features that enforce limitations on the use of the Ps Services Services or the Ps Services Platform;
• Reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of as regards Ps Services Services or Ps Services Platform or any part thereof, except and only to the extent this is expressly permissible by applicable law;
• Use the Ps Services Services or the Ps Services Platform in any manner that could damage, disable, overburden, or impair it, including, without limitation, using the Ps Services Services or the Ps Services Platform in an automated manner;
• Modify, adapt, translate or create derivative works based upon the Ps Services Services and the Ps Services Platform or any part thereof, except and only to the extent that that this is permissible by applicable law;
• Intentionally interfere with or damage operation of the Ps Services Services or the Ps Services Platform or any other user’s enjoyment of it, by any means, including uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code or file with contaminating or destructive features;
• Use any robot, spider, other automatic device, or manual process to monitor or copy the Ps Services Platform without prior written permission;
• Interfere or disrupt the Ps Services Platform or networks connected to the Ps Services Platform;
• Take any action that imposes an unreasonably or disproportionately large load on Ps Services’s infrastructure/network;
• Use any device, software or routine to bypass the Ps Services Platform’s robot exclusion headers, or interfere or attempt to interfere, with the Ps Services Services;
• Forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through the Ps Services Platform or to manipulate Your presence on the Ps Services Platform;
• Sell the Ps Services Services, information, or software associated with or derived from it;
• Use the facilities and capabilities of the Ps Services Platform to conduct any activity or solicit the performance of any illegal activity or other activity which infringes the rights of others;
• Breach this Agreement, the SSOID Agreement or any other agreement or policy as may be applicable pursuant to the T&Cs;
• Provide false, inaccurate or misleading information;
• Use the Ps Services Platform to collect or obtain personal information, including without limitation, financial information, about other users of the Ps Services Platform, except and only as expressly provided in the T&Cs;
• Avail Ps Services Services with what Ps Services reasonably believes to be potentially fraudulent funds;
• Use the Ps Services Services in a manner that results in or may result in complaints, disputes, reversals, chargebacks, fees, fines, penalties and other liability to Ps Services, a third party or User;
• Use the Ps Services Services in a manner that Ps Services or any payment card network reasonably believe to be an abuse of the payment card system or a violation of payment card network rules;
• Send automated request of any kind to the Ps Services Platform without express permission in advance from Ps Services.

Information Collected

Ps Services will only collect, store, use, and share Your personal information (including email address) as it is defined by our Privacy Policy and as regulated by Indian laws.

• It is being accepted by the User that the contact information is collected and used by the company to provide services opted for, which is provided by the User from time to time on Website. The User’s need is fulfilled accordingly. This information is used by the Website/Company to improve the services for the User by providing regular updates.
• There is certain information which maybe tracked automatically by the Company/Website about the User like User’s IP address and User’s behavior on Website. The User knows that such information may include the URL that the User visited prior to accessing the Website, the URL which the User subsequently visits (whether or not these URLs form a part of the Website), the User’s computer & web browser information, the User’s IP address, etc.
• If any User Chooses to buy any product or services from the Company/Website, the User is allowing the Company/Website to gather the personal information of the User.
• The User is aware that if any information which is provided by User whether it is posted message/ review / feedback anywhere on Website can be used by the Company/Website to help out the User in every possible way in future. This retained information can be used to resolve disputes, provide customer support, troubleshoot problems with such information, if requested, may be provided to judicial or authorities of requisite jurisdiction, or otherwise used by the Company/Website as permitted by applicable laws.
• The Company/Website can ask or request the User to provide the reviews for the products/services which are purchased/ availed by the User from Website.
• The information like content/reviews/surveys/feedback which is submitted by the User to Company/Website may or may not be stored, uploaded, published or displayed in any manner. The User authorizes the Website/Company to remove any such content, review, survey or feedback from Website which has been submitted by User, without cause or being required to notify the User of the same.

Any information which is specifically mentioned by Ps Services as Confidential shall be maintained confidentially by the user and shall not be disclosed unless as required by law or to serve the purpose of this agreement and the obligations of both the parties therein.

Fees Payment

Ps Services reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the services. Ps Services further reserves the right to alter any and all fees from time to time, without notice. The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the services.

In case, there is a short charging by Ps Services for listing, services or transaction fee or any other fee or service because of any technical or other reason, it reserves the right to deduct/charge/claim the balance subsequent to the transaction at its own discretion. Any increase in the price charged by Company on account of change in rate of taxes or imposition of new taxes by shall have to be borne by customer.

In the rare possibilities of the reservation not getting confirmed for any reason whatsoever, we will process the refund and intimate User of the same. Ps ServicesIndiaOnline is not under any obligation to make another booking in lieu of or to compensate/ replace the unconfirmed one. All subsequent further bookings will be treated as new transactions with no reference to the earlier unconfirmed reservation.

The User shall request Ps ServicesIndiaOnline for any refunds against the unutilized or ‘no show’ air or hotel booking for any reasons within 90 days from the date of departure for the air ticket and/or the date of check in for the hotel booking. Any applicable refunds would accordingly be processed as per the defined policies of Airlines, hotels and Ps ServicesIndiaOnline as the case may be. No refund would be payable for any requests made after the expiry of 90 days as above and all unclaimed amounts for such unutilized or ‘no show’ air or hotel booking shall be deemed to have been forfeited.

Usage Of Mobile Number

Ps Services may send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via SMS or by voice call on the contact number given by the User at the time of booking; Ps Services may also contact the User by voice call, SMS or email in case the User couldn’t or hasn’t concluded the booking, for any reason what so ever, to know the preference of the User for concluding the booking and also to help the User for the same. The User hereby unconditionally consents that such communications via SMS and/ or voice call by Ps Services is

• upon the request and authorization of the User,
• ‘transactional’ and not an ‘unsolicited commercial communication’ as per the guidelines of Telecom Regulation Authority of India (TRAI) and
• in compliance with the relevant guidelines of TRAI or such other authority in India and abroad. The User will indemnify Ps Services against all types of losses and damages incurred by Ps Services due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous compliant raised by the User on Ps Services with respect to the intimations mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever.

Onus Of The User

Ps Services is responsible only for the transactions that are done by the User through Ps Services. Ps Services will not be responsible for screening, censoring or otherwise controlling transactions, including whether the transaction is legal and valid as per the laws of the land of the User. The User warrants that they will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the use of the services. The User further warrants that they will comply with all applicable laws and regulations regarding use of the services with respect to the jurisdiction concerned for each transaction. The User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from availing the Services under the laws of India or other applicable law.

Advertisers On Ps Services Or Linked Websites

Ps Services is not responsible for any errors, omissions or representations on any of its pages or on any links or on any of the linked website pages. Ps Services does not endorse any advertiser on its web pages in any manner. The Users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.

The linked sites are not under the control of Ps Services and Ps Services is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. Ps Services is providing these links to the Users only as a convenience and the inclusion of any link does not imply endorsement of the site by Ps Services.

Refund Policy

All services rendered by the Company are provided on a non-refundable basis. This includes, but not limited to, setup fees, monthly fees, upgrade fees and professional services fees. In addition, if your services / account are cancelled by the company for violation of this Agreement or the attached Acceptable Use Policy, all payments made to the Company become completely non refundable. Customer agrees not to charge back any payments via Credit Card/ Debit Card/ Net Banking/ Direct Transfer or any other form of payment for services rendered. In the event that a customer files a charge back or other payment dispute, they will be considered to be in violation of this agreement and may be subject to collection action.

Cancellation Policy

The Customer agree that the booking made are subject to the cancellation policy set out on the booking page or as communicated to the customers in writing.

Insurance

Unless explicitly provided by Ps Services in any specific service or deliverable, obtaining sufficient insurance coverage is the obligation/option of the user and Ps Services doesn’t accept any claims arising out of such scenarios. Insurance, if any provided as a part of the service/ product by Ps Services shall be as per the terms and conditions of the insuring company. The User shall contact the insurance company directly for any claims or disputes and Ps Services shall not provide any express or implied undertakings for acceptance of the claims by the insurance company.

Force Majeure Circumstances

Ps Services shall have no liability to you for any interruption or delay in access to the Site irrespective of the cause. Force Majeure event shall be one when there is any cessation, interruption or delay in the performance of Ps Services’s obligations due to causes beyond its reasonable control, including but not limited to: technical, earthquake, flood, or other natural disaster, act of God, labour controversy, civil disturbance, war (whether or not officially declared) or the inability to obtain sufficient supply of service, transportation, or other essential commodity or service required in the conduct of its business, or any change in or the adoption of any law, regulation, judgment or decree. Without limiting the foregoing, under no circumstances shall panind.com be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, floods, storms, explosions, acts of God, war, actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning of your information and or data received and or stored or any of our service/s.

Safety Of Data Downloaded

The User understands and agrees that any material and/or data downloaded or otherwise obtained through the use of the Service is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data.

Nevertheless, Ps Services will always make its best endeavors to ensure that the content on its websites or other information channels are free of any virus or such other malwares. Feedback From Customer And Solicitation:

The User is aware that Ps ServicesIndiaOnline provides various services like hotel bookings, car rentals, holidays and would like to learn about them, to enhance his / her travel experience. The User hereby specifically authorizes Ps ServicesIndiaOnline to contact the User with offers on various services offered by it through direct mailers, e-mailers, telephone calls, short messaging services (SMS) or any other medium, from time to time. In case that the customer chooses not to be contacted, he /she shall write to Ps ServicesIndiaOnline for specific exclusion at service@Ps Services or provide his / her preferences to the respective service provider. The customers are advised to read and understand the privacy policy of Ps Services on its website in accordance of which Ps Services contacts, solicits the user or shares the user’s information.

Proprietary Rights

Ps Services may provide the User with contents such as sound, photographs, graphics, video or other material contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks, or other intellectual property rights and laws.

The User may use this material only as expressly authorized by Ps Services and shall not copy, transmit or create derivative works of such material without express authorization.

The User acknowledges and agrees that he/she shall not upload post, reproduce, or distribute any content on or through the Services that is protected by copyright or other proprietary right of a third party, without obtaining the written permission of the owner of such right.

Any copyrighted or other proprietary content distributed with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject the User to personal liability or criminal prosecution.

Visa Obligations Of The User

The travel bookings done by Ps Services are subject to the applicable requirements of Visa which are to be obtained by the individual traveller.

Ps Services is not responsible for any issues, including inability to travel, arising out of such Visa requirements and is also not liable to refund for the untraveled bookings due to any such reason.

Personal And Non-Commercial Use Limitation

Unless otherwise specified, the Ps Services services are for the User’s personal and non – commercial use. The User may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Ps Services website(s) without the express written approval from Ps Services.

Indemnification

The User agrees to indemnify, defend and hold harmless Ps Services and/or its affiliates, their websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Ps Services and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this agreement.

The user shall be solely and exclusively liable for any breach of any country specific rules and regulations or general code of conduct and Ps Services cannot be held responsible for the same.

Right To Refuse

Ps Services at its sole discretion reserves the right to not to accept any customer order without assigning any reason thereof. Any contract to provide any service by Ps Services is not complete until full money towards the service is received from the customer and accepted by Ps Services.

Without prejudice to the other remedies available to Ps Services under this agreement, the TOS or under applicable law, Ps Services may limit the user’s activity, or end the user’s listing, warn other users of the user’s actions, immediately temporarily/indefinitely suspend or terminate the user’s registration, and/or refuse to provide the user with access to the website if:

• The user is in breach of this agreement, the TOS and/or the documents it incorporates by reference;
• Ps Services is unable to verify or authenticate any information provided by the user; or
• Ps Services believes that the user’s actions may infringe on any third party rights or breach any applicable law or otherwise result in any liability for the user, other users of the website and/or Ps Services.

Ps Services may at any time in its sole discretion reinstate suspended users. Once the user have been indefinitely suspended the user shall not register or attempt to register with Ps Services or use the website in any manner whatsoever until such time that the user is reinstated by Ps Services.

Notwithstanding the foregoing, if the user breaches this agreement, the TOS or the documents it incorporates by reference, Ps Services reserves the right to recover any amounts due and owing by the user to Ps Services and/or the service provider and to take strict legal action as Ps Services deems necessary.

Right To Cancellation By Ps Services In Case Of Invalid Infromation From User

The User expressly undertakes to provide to Ps Services only correct and valid information while requesting for any services under this agreement, and not to make any misrepresentation of facts at all. Any default on part of the User would vitiate this agreement and shall disentitle the User from availing the services from Ps Services.

In case Ps Services discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of them is not correct or that any fact has been misrepresented by him, Ps Services in its sole discretion shall have the unrestricted right to take any steps against the User(s), including cancellation of the bookings, etc. without any prior intimation to the User. In such an event, Ps Services shall not be responsible or liable for any loss or damage that may be caused to the User or any of them as a consequence of such cancellation of booking or services.

The User unequivocally indemnifies Ps Services of any such claim or liability and shall not hold Ps Services responsible for any loss or damage arising out of measures taken by Ps Services for safeguarding its own interest and that of its genuine customers. This would also include Ps Services denying/cancelling any bookings on account of suspected fraud transactions.

Interpretation Number And Gender

The terms and conditions herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine, feminine and neuter form. The words “include”, “includes” and “including” shall be deemed to be followed by the phrase “without limitation”. Unless the context otherwise requires, the terms “herein”, “hereof”, “hereto”, ‘hereunder” and words of similar import refer to this agreement as a whole.

Severability

If any provision of this agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.

Headings

The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of this agreement, terms and conditions, notices, or the right to use this website by the User contained herein or any other section or pages of Ps Services Websites or its partner websites or any provision hereof in any manner whatsoever.

In the event that any of the terms, conditions, and notices contained herein conflict with the Additional Terms or other terms and guidelines contained within any particular Ps Services website, then these terms shall control.

Relationship

None of the provisions of any agreement, terms and conditions, notices, or the right to use this website by the User contained herein or any other section or pages of Ps Services Websites or its partner websites, shall be deemed to constitute a partnership between the User and Ps Services and no party shall have any authority to bind or shall be deemed to be the agent of the other in any way.

Updation Of The Information By Ps Services

User acknowledges that Ps Services provides services with reasonable diligence and care. It endeavors its best to ensure that User does not face any inconvenience. However, at some times, the information, software, products, and services included in or available through the Ps Services websites or other sales channels and ad materials may include inaccuracies or typographical errors which will be immediately corrected as soon as Ps Services notices them. Changes are/may be periodically made/added to the information provided such. Ps Services may make improvements and/or changes in the Ps Services websites at any time without any notice to the User. Any advice received except through an authorized representative of Ps Services via the Ps Services websites should not be relied upon for any decisions.

Modification Of These Terms Of Use

Ps Services reserves the right to change the terms, conditions, and notices under which the Ps Services websites are offered, including but not limited to the charges. The User is responsible for regularly reviewing these terms and conditions.

Refund policy mentioned on the ticket is indicative. The actual cancellation charges are determined by bus operators and bus providers at the actual time of cancellation. Ps Services has no role in the cancellation charges.

Jurisdiction

Ps Services hereby expressly disclaims any implied warranties imputed by the laws of any jurisdiction or country other than those where it is operating its offices. Ps Services considers itself and intends to be subject to the jurisdiction only of the courts of NCR of Delhi, India.

Responsibilities Of User Vis-A-Vis The Agreement

The User expressly agrees that use of the services is at their sole risk. To the extent Ps Services acts only as a booking agent on behalf of third party service providers, it shall not have any liability whatsoever for any aspect of the standards of services provided by the service providers. In no circumstances shall Ps Services be liable for the services provided by the service provider. The services are provided on an “as is” and “as available” basis. Ps Services may change the features or functionality of the services at any time, in their sole discretion, without notice. Ps Services expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. No advice or information, whether oral or written, which the User obtains from Ps Services or through the services shall create any warranty not expressly made herein or in the terms and conditions of the services. If the User does not agree with any of the terms above, they are advised not to read the material on any of the Ps Services pages or otherwise use any of the contents, pages, information or any other material provided by Ps Services. The sole and exclusive remedy of the User in case of disagreement, in whole or in part, of the user agreement, is to discontinue using the services after notifying Ps Services in writing.
